(PROPOSED) AMENDMENT TO THE UNITED STATES CONSTITUTION

Section 1

No federal, state or local law shall exist that meets the conditions of domestic tyranny:  

a.) The law in its totality, or in its design to place a chilling effect on society, violates an act of civil freedom. Civil freedom is "the ability for persons to do as they will, as long as no direct intentional harms are present to others." Persons are humans of any race, ethnicity, language, creed, nationality, sex, sexual orientation, conscience, lifestyle choice, political party or disability.

(b.) The sentencing or fines associated with law that meets Section 1(a)'s provisions are extreme and unreasonable. Extreme and unreasonable sentencing [as it relates to section 1(a)] is defined as meeting any of these conditions: incarceration, public humiliation, stripping of citizenship, house arrest, use of torture, dismemberment, physical or emotional assault, work/slave camps, starvation or death sentences. Extreme and unreasonable fines [relating to Section 1(a)] are defined as property confiscation, or any monetary penalty.

Section 2

Within the context of civil freedoms, the right of privacy is guaranteed to all persons.

Section 3

More perfect union, domestic tranquility, general welfare, states' rights, majority will, and police powers are not to supersede civil freedoms - for with the open violation or denial of personal liberty through the law, we have tyranny.

Section 4

(a.) In the context of federal, state, or local laws, national security threats must show evidence of specifically attempting to damage our government.

(b.) In the context of federal, state, or local laws, national security threats against the United States shall consist only in war, rebellion, invasion, treason, or acts of terrorism. In the spirit of our coequal branches of government,  measures emanating from national security threats must have the mutual consent of the executive and legislative branches.

(c.) Within the context of civil freedoms, any federal state or local law passed in response to national security threats may be implemented only for the specific national security threats for which it was so reasoned.

Section 5

In addition to the normal amendment procedures presently contained in Article V, national constitutional amendments concerning individual freedom, equality or the concept of persons, must also be approved by a majority vote of the people.
